Tonicchord.com reserves the right, at our sole discretion, to limit the quantity of items purchased per order. These restrictions may be applicable to orders placed by the same account, the same credit card, and also to orders that use the same billing and/or shipping address. The reason for this is to limit or prevent fraudulent transactions. We will provide notification to the customer should such limits be applied. Please note that certain orders constitute improper use of tonicchord.com and its services. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Your account may also be restricted or terminated for any reason, at our sole discretion. Tonicchord.com also reserves the right, at our sole discretion, to prohibit sales to dealers or resellers. For purposes of these Terms of Use, reselling shall be defined as purchasing or intending to purchase any product(s) from tonicchord.com for the purpose of engaging in a commercial sale of that same product(s) with a third party without our permission.

Privacy Policy

Tonic Chord will not sell your information in any way to a third party. Any customer information obtained automatically or not won't be used for any purposes beyond the necessities of order fulfilment and customer service.

Copyrights and Trademarks

All of our products are copyright protected. It is intended for private use only. You may not copy, reproduce, republish, resell, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, make available to the public, or otherwise use tonicchord.com products in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any tonicchord.com products, except for your own personal, non-commercial use. Tonic Chord Limited is headquartered in New Zealand and complies with domestic copyright law. Please make sure that you are legally eligible to download certain products in your country. Tonic Chord Limited will take no responsibilty to any legal consequences to any products that you purchased from Tonicchord.com

Tonicchord.com reserves all intellectual property rights in all text, programs, products, processes, technology and content on this website. Tonicchord.com names and logos and all related product and service names, design marks and slogans are the trademarks or service marks of Tonic Chord.  All other marks are the property of their respective companies. No trademark or service mark license is granted in connection with the materials contained on this Site. Access to this Site does not authorize anyone to use any name, logo or mark in any manner.

Any infringement of these terms of service may lead us to take legal action.

Delivery

Once your payment gets processed, you will receive a link via email, which will allow you to download MP3 files of the product. Downloads are final since they are unretractable. The download link will be valid for 7 days, limited to up to 3 downloads. After this period, Tonic Chord is absolved from any further responsibility with respect to the download. As a part of the purchase, we may also include a tracked, physical confirmation letter which will be sent in certain cases.

Return Policy

We do not offer refunds for any product in our website. Once an order is made, it cannot be cancelled, as the downloadable goods are supplied almost immediately after purchase. If you have any problems with our product, please contact support@tonicchord.com. We will respond to your case and try our best to solve the problem. That includes, if necessary, providing you with a replacement download of the product you purchased, at no additional cost. Although we can assist you with download problems, Tonic Chord is not responsible for any third party related failures (eg. Incompatibility between your device and the product, lost credit card, e.t.c.). By downloading a product, you agree to forfeit your right to any refund, chargeback or "unauthorised transaction" claims. 

If you make an "unauthorised transaction" on PayPal, you agree to receive a tracked, physical confirmation letter to your address and pay for the incurring charges.  

Liability

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL OR EQUITABLE THEORY, WHETHER IN TORT, CONTRACT, STRICT LIABILITY OR OTHERWISE, SHALL TONICCHORD.COM OR ANY OF ITS AFFILIATES, EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, VENDORS OR SUPPLIERS BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL LOSSES OR DAMAGES OF ANY NATURE ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE TONICCHORD.COM WEB SITE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, LOSS OF DATA, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, EVEN IF AN AUTHORIZED REPRESENTATIVE OF TONICCHORD.COM HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL TONICCHORD.COM BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE FEES PAID BY YOU IN CONNECTION WITH YOUR USE OF THE SITE DURING THE SIX MONTH PERIOD PRECEDING THE DATE ON WHICH THE CLAIM AROSE.
